There is a Danger of Injury Accidents Caused by Unsafe Bus Drivers and Bus Companies Similar to Truck Drivers and Companies

This site is mainly devoted to safety issues and accidents involving semi truck drivers and companies.  The Federal Motor Carrier Safety Administration (FMCSA) issues regulations that are designed to make the trucking industry as safe as possible and prevent fatal and injury accidents.  However, bus drivers and bus companies are also subject to federal regulations because of the significant injuries and damage that can be caused by an unsafe bus or bus driver.

Earlier this month, 17 people died when a chartered bus went off the road and crashed in Texas.  The bus company, formerly called Angel Tours but now called Iguala Busmex, had a poor track record and had buses taken out of service several times in the previous few years.  A bus or semi truck is placed out of service when it is inspected and found to have safety violations that make it unsafe to continue operating.  The bus or semi truck is then ordered off of the road until the violation is corrected.  A few days later, another bus from the same chartered bus company was taken off of the road in Massachusetts, according to a recent news article.  The company has been called an "imminent hazard" to the public by the FMCSA. 

Additionally, an investigation into the bus driver who was involved in the Texas crash that killed 17 people revealed that he had been cited three times since 2001- once for DUI and twice for speeding.  He also had two failed inspections as a bus driver approximately a year before the fatal accident.

Surprisingly, this bus company that had such a poor safety record and employed this driver with the bad driving history was used extensively by school districts in Texas.  Clearly, those who employ bus drivers and bus companies need to investigate the driving and inspection records of these drivers and companies to make sure they are qualified to safely operate a bus.

Semi Trucks Must Keep a Safe Following Distance to Avoid an Accident

We have all heard of serious injury accidents occurring because a vehicle is following another vehicle too closely and is unable to stop in time.  The danger is heightened when the following vehicle is a semi truck because its size and weight make it more difficult to stop quickly and the subsequent damage from an accident is often much greater.

When a semi truck driver is going to stop a vehicle to avoid an accident, he/she must go through a few steps first.   The driver must perceive the hazard and then decide what to do.  The more fatigued a driver is, for instance a semi truck driver who has been on the road for hours, the longer this perception and decision time takes.  After the decision to stop is made, there is physical reaction time where the driver has to put his/her decision to stop into action.  Once the semi truck driver puts his/her foot on the brakes, the air brakes on a semi truck lag for a short period of time to allow the brakes to obtain the air they need.  Semi truck brakes typically do not operate as quickly as regular passenger cars.  This delay is approximately 1/2 of a second, but at a speed of 65 miles per hour, the delay could mean an extra 50 feet before the semi truck begins to stop.  Once the brakes are applied, friction begins to slow the vehicle to a stop.  The weight and speed of the vehicle along with any road conditions (water, ice, etc.) can prolong this process. 

At normal highway speeds, a semi truck may take approximately 300 feet to stop to avoid an injury accident from the time the semi truck driver perceives the hazard.  If the semi truck is following a vehicle closely, there is a good chance there will not be enough room or time to stop without causing an accident.  As a result, semi trucks should leave more distance from the vehicle in front of them than regular cars.  It is recommended that semi trucks stay one second behind the vehicle in front of them for every ten feet of vehicle plus an extra second if driving more than 40 miles per hour.

Trucking Company Sued After Semi Truck Driver Causes Crash That Kills Other Driver

A lawsuit was filed after a man driving a pickup truck was hit head-on in an accident with a semi truck that killed the pickup truck driver.  According to the documents filed in the lawsuit, the semi truck driver caused the fatal accident when he drove his semi truck that was 37,000 pounds overweight with faulty brakes.  Additionally, the lawsuit alleges that the semi truck driver was dangerously driving on a two lane road to avoid a weigh station on a nearby highway.  The plaintiffs also sued the trucking company that employed the semi truck driver because they allege the trucking company, B & J Transportation, has a history of serious injury accidents, poor safety reviews and equipment violations. 

The Federal Motor Carrier Safety Regulations require semi truck drivers to perform a thorough inspection of the semi truck before and after each trip.  Brakes, of course, are one area on the semi truck that are supposed to be checked to make sure they are operating properly before a semi truck goes out on the road.  We have found that these pretrip inspections of the semi truck are not always done as they take time away from driving and transporting goods, and trucking companies do not make any money when their trucks are parked.

Florida's Public Road System Ranked Poorly for Motor Vehicle Accident Deaths and Other Areas in New Study

A recent study by the Reason Foundation looked at the roads in the various states and determined which states had the safest, and the most unsafe, roads.  The study looked at different areas of roadway safety such as pavement condition, bridge condition, deaths from motor vehicle accidents, traffic congestion and maintenance costs.  Overall, the study found that 24.1% of the bridges in the U.S. are obsolete or deficient in some way and they will not be properly and safely repaired any time soon. 

Florida's roadway system ranked 41st among the states in the study (the same ranking as the prior year).   Florida's rankings were much worse for urban areas as opposed to rural areas.  Florida also did poorly in terms of the rate of deaths from motor vehicle accidents, ranking 35th among the states.  Florida did better in terms of bridge deficiency, ranking 12th among the states.

Government Makes Recommendations to Prevent Injury Accidents and Make Roads Safer

Preventing injury accidents and fatal accidents involving semi trucks and generally making the roads safer is the goal of the Federal Motor Carrier Safety Administration.  The rate of deaths from motor vehicle accidents is currently lower than it has ever been, although that rate has not changed much over the last several years at approximately 43,000 deaths from accidents in the U.S. per year.

The following are some of the recommendations from government officials and safety experts:

    1.    Formal audits of the roads and intersections to evaluate them for safety improvements;

    2.    Adding rumble strips and stripes and median barriers to prevent the many accidents that occur when vehicles depart from their lanes;

    3.    Eliminating sharp dropoff angles on the road shoulders to make it easier for vehicles to get back on the road when they have driven onto the shoulder;

    4.    Adding turn lanes at intersections with high volumes of turning traffic; and

    5.    Adding raised medians and pedestrian refuge areas at pedestrian crossings.

Safety experts estimate that the number of injury and fatal accidents can be significantly reduced if these recommendations are implemented.  It remains to be seen which, if any, of these recommendations are actually put into place.

Unsafe Moving Companies Cited by Government

The Federal Motor Carrier Safety Administration (FMCSA) which regulates semi truck drivers and trucking companies to make the roads safer and tries to prevent injury accidents and deaths involving semi trucks recently completed an investigation of almost 350 moving companies who operate semi trucks in thirteen states, including Florida, according to the FMCSA website.  Apparently, there were approximately 4,000 complaints of moving companies and their semi trucks in 2007 ranging from unsafe driving to unscrupulous consumer practices.

The FMCSA found over 100,000 safety and consumer protection violations and assessed over $300,000 worth of fines.  Common examples of the violations included: holding customer's property hostage, operating without legal authority and failing to keep proper records.

Are Semi Truck Drivers Medically Fit to Drive Safely?

Following up on a recent post about the increased danger of serious injury accidents caused by semi truck drivers who are not physically qualified to operate an 80,000 pound tractor trailer, I saw this article on the Jacksonville, Florida Channel 4 website.  The article suggests that the federal regulation that requires semi truck drivers to be medically cleared by a licensed medical professional before driving a semi truck is basically meaningless as semi truck drivers are able to use forged medical certificates or have their medical evaluations with doctors whom they know will qualify them regardless of their medical condition.  This quote from the article is quite telling: "One Ohio doctor contacted by the [Transportation] Committee said forgery of medical certificates is so commonplace, 'no one gets alarmed by it anymore.'"

As discussed in the recent post, the federal regulations are supposed to require every semi truck driver who drivers interstate to get evaluated by a licensed medical professional before driving to ensure semi truck drivers are medically able to safely drive and to prevent injury and fatal accidents caused by medically unfit drivers.  Certain medical conditions, such as epilepsy and insulin dependant diabetes, automatically disqualify a person from driving a semi truck under the regulations.  However, if no one is enforcing these regulations, drivers who are more prone to seizures, heart attacks, dizziness, blackouts and other unsafe conditions are free to drive semi trucks on the roads with no recourse.

Fewer Truck Injury and Fatal Accidents is One Benefit of Higher Gas Prices

One benefit of the drastic increase in gas prices is that there have been fewer serious injury and fatal accidents involving semi trucks and all vehicles on the roads.  According to a recent article on Sfgate.com, the National Safety Council reported a 9% drop in deaths from motor vehicle accidents in the first five months of this year compared to last year (although deaths from motor vehicle accidents have increased in eight states). 

In Florida, death rates from vehicle accidents are down 11% this year.  There are several factors that contribute to the number of serious injuries and deaths that result from motor vehicle accidents that are unrelated to gas prices, such as increased seat belt usage and better safety engineering in vehicles, but two effects that are likely contributing to the fewer fatal accidents are that people are driving less and more slowly to save money on gas.  When there are fewer vehicles on the road that are moving more slowly, the logical result is fewer and less serious accidents.
