Trucking Company Sued After Semi Truck Driver Causes Crash That Kills Other Driver
A lawsuit was filed after a man driving a pickup truck was hit head-on in an accident with a semi truck that killed the pickup truck driver. According to the documents filed in the lawsuit, the semi truck driver caused the fatal accident when he drove his semi truck that was 37,000 pounds overweight with faulty brakes. Additionally, the lawsuit alleges that the semi truck driver was dangerously driving on a two lane road to avoid a weigh station on a nearby highway. The plaintiffs also sued the trucking company that employed the semi truck driver because they allege the trucking company, B & J Transportation, has a history of serious injury accidents, poor safety reviews and equipment violations.
The Federal Motor Carrier Safety Regulations require semi truck drivers to perform a thorough inspection of the semi truck before and after each trip. Brakes, of course, are one area on the semi truck that are supposed to be checked to make sure they are operating properly before a semi truck goes out on the road. We have found that these pretrip inspections of the semi truck are not always done as they take time away from driving and transporting goods, and trucking companies do not make any money when their trucks are parked.
